Executive Order 5819—Revocation of Withdrawal of Public Lands Pending Resurvey, Colorado
It is hereby ordered that Executive Order No. 4900, dated June 2, 1928, which withdrew the public lands in T. 8 S., R. 95 W., sixth principal meridian, Colorado, pending a resurvey, be, and the same is hereby, revoked.
And it is hereby ordered, pursuant to Public Resolution 85 of June 12, 1930 (46 Stat. 580), and subject to valid rights, that if otherwise subject to disposition such of the above-described lands as are not withdrawn for national-forest purposes and are not withdrawn by Executive Order No. 5327, dated April 15, 1930, for oil shale, shall be opened under the terms and conditions of such resolution and the regulations issued thereunder to entry under the homestead or desert land laws only, and such of the lands as are not withdrawn for national-forest purposes but are withdrawn by said Executive Order No. 5327, where of the proper character, to entry under the stock-raising homestead laws only, by qualified ex-service men for whose service recognition is granted by the resolution, for a period of 91 days beginning with the date of the official filing of the plat of resurvey of said township. Thereafter, the unreserved public lands in the township shall be subject to appropriation by the general public under any public land law applicable thereto, and the public lands outside the national forest, but withdrawn by Executive Order No. 5327, where of the proper character, shall be subject to appropriation by the general public under the stock-raising homestead laws only.
Subsequent to the date hereof and prior to the date of restoration to general disposition as herein provided, no rights may be acquired to the released land by settlement in advance of entry or otherwise except strictly in accordance herewith.
