
Executive Order 7010-E—Approving Modification to Agreement Between Employer Members of the Division of the Painting, Paperhanging and Decorating Division of the Construction Industry and Certain of Their Employees in the Region of Omaha, Nebraska, Council Bluffs, Iowa, and Vicinity
An application having been made pursuant to and in full compliance with the provisions of Title I of the National Industrial Recovery Act, approved June 16, 1933, the Code of Fair Competition for the Painting, Paperhanging and Decorating Division of the Construction Industry, approved March 12, 1934, and Regional Collective Bargaining Agreement No. 3, under said Code for the Region of Omaha, Nebraska, Council Bluffs, Iowa, and vicinity, as defined in said Agreement, by the Brotherhood of Painters, Decorators and Paperhangers of America, Local Unions No. 109, No. 422 and No. 706, and Omaha Chapter of the International Society of Master Painters and Decorators, Inc., and the Contracting Painters and Decorators Association of Omaha and vicinity, all of which are parties to and sponsors of said Agreement, for a modification of said Agreement by deleting therefrom in Section 2 of Article IX thereof "April 1, 1935" and inserting in lieu thereof, "April 1, 1936", said applicants averring in said application that such modification is necessary to continue to effectuate the policies and purposes of the National Industrial Recovery Act and to prevent a return to the conditions that existed prior to the approval of said Agreement, and the National Industrial Recovery Board having rendered its report thereon, including therein recommendations and findings of fact, among others that the experience in the operation of said Agreement has established that such modification is proper, that said modification is necessary to effectuate the policy of Title I of said Act and that said modification in all respects complies with the pertinent provisions of Title I of said Act;
Now, Therefore, I, Franklin D. Roosevelt, President of the United States, pursuant to authority vested in me by Title I of the National Industrial Recovery Act, approved June 16, 1933, pursuant to the Code of Fair Competition for the Painting, Paperhanging and Decorating Division of the Construction Industry, approved March 12, 1934, and otherwise, do hereby adopt and approve the report, recommendations and findings of the National Industrial Recovery Board, and do hereby order that said modification and said Agreement as so modified be, and the same hereby are approved:
Provided, that the National Industrial Recovery Board may provide such exceptions to and exemptions from the operation of said Agreement, either as the result of my approval thereof, dated November 15, 1934, or of my approval herein, with or without conditions therefor, as may appear necessary to effectuate the policies and purposes of said Act and said Code, or to avoid undue hardship to any individual or individuals, and
Provided, Further, that the modification and approval herein made be subject to such cancellation or modification by the National Industrial Recovery Board as may appear necessary and proper upon subsequent showing of fact to said Board, and
Provided, Further, that this Order shall be effective as of this date, provided that within thirty (30) days of said date there shall be published on at least three (3) occasions hereafter by the applicant groups in a paper or papers of general circulation in the said Region in intervals of not less than two (2) nor more than four (4) days apart, notices setting forth the modification herein approved, the territory to which it is applicable, the substance of the Agreement as so modified, and of this Order; and that this Order shall be subject to such revision or stay in operation by the National Industrial Recovery Board as may appear proper by reason of additional facts established and filed with the National Industrial Recovery Board, 616 Albee Building, Washington, D.C., within thirty (30) days of the last of said publications.
